As Noobie says.. depends on catagory

With a bent frame it would DEF be a cat B and require a certificate of condition before it could be sold.
That WOULD be a matter for the police as the bike should not be on the road without the correct paperwork

Have taken a few bits off and found the welds split behind the headstock with a 3mm gap at one point.

Should defo' be a CAT B and not on the road then with split welds.

Take it back, second thoughts get them to collect!, Mention trading standards and watch them run to the till to give you your money back!!

Get on the phone and tell him to pick it up bringing with him your money.
If he insists you return the bike to the shop just tell him you are not risking your life on this dangerous piece of shit.
If he still refuses just tell him your phoning trading standards and the police.

Take photos of the frame cracks and cut the shit head out of your christmas card list.

I would contact Trading Standards Right Away,what your so called friend has done is illegal.

I guarantee you he will give you your money back once Trading Standars are Involved

I am listening Ian but do not want to jump the gun as it were.
There will be more info to follow later.
I am going to ask for money back.
The bike is officially listed as cat D on 22 april 2006. I have checked I dont know if he knew this or not. He may not have seen all of the damage on the bike and was riding the bike himself for a couple of months.

You've had lots of excellent advice. It's clear you have been sold a bike that should never have been put on the road by a dealer who should have known beter and probably did know what he was doing and took a chance at your exspense

So I have to ask, what are you going to do about it?

Think really that is up to Paddy guys..
He may well not wish to 'publish' his intentions for legal reasons as it could affect anything he does now..

Paddy is not a fool and not even slightly daft, rest assured he will sort it out..
and when it IS all sorted I am sure he will spill the beans on the bugger who has taken the pee

If I had proof he knew before he sold it to me I would get a solicitor but I dont have that proof

He is a dealer.. He has NO excuse what so ever for selling the bike to you

Honestly mate, have a quick word with CAB.. you do not need to mention any names to start with

The rules governing what a dealer can and cannot get away with are VERY VERY strict, and there is absolutely no doubt what so ever this bum has crossed the line.. big time

And the fact that it was a recorded D is also VERY suspicious as a D is cosmetic only.
There is not an assessor in the world who would not have spotted cracks in the frame.. That means it has been in another BIG one since it was written off

I should also say that if he was genuine and it was an oops, AND he is indeed a mate, then it would be reasonable to expect him to say really sorry, here's your lolly back Paddy, and shake your hand

He would not be taking the wee wee as he obviously is !

John,when you get a H P I Check ,done it tells you at the bottom were and when it had it's last HPI.
