The post arrived today and I received a letter from the 3rd parties insurance.
Confirmation that liability has been admitted. Apologies and they would like to help whilst keeping losses to a minimum.....Yeah right.
Also in this letter was a cheque for £2000 in respect of an estimated value of my bike.
They can keep me mobile and do the vehicle repairs at no cost to me.
If my vehicle is uneconomical to repair
then they would discuss and agree to
the market value & deduct a scrap value
off that if I wish to reclaim my bike.
They also pointed out that it is my responsibility to mitigate any losses to a minimum which is a legal principle apparently? If I choose to not accept their offer then they will only pay the lower amount.

They would much rather deal with you directly as it's cheaper for them.

At this point you can choose to

1. Let them take and repair the bike.
2. Do or arrange the repairs yourself.
3. Accept or negotiated with them on the scrap value.

In all the above you can negotiate with them, they've accepted liability so it's a straightforward how and how much.

If the claims handling company are still acting for you then you're out of the loop in the sense they'll be deciding what course to take.

My view is the claims handling company will approach it with the intent to make the most money for them.
That will probably be by loaning you a bike, dragging it all on for as long as possible before finally writing your bike off.

The line about mitigating losses and keeping your costs to a minimum is normal. In an insurance claim you can't just load what you claim for, it should be based on actual loss or cost.

There is, for example, a guideline amount for daily hire of a replacement.

No bike, got a text yesterday to say they
ARE collecting the bike, no date, time etc.
I did text back to tell them i'm not interested, but it bounced back unanswered. I will try and contact via their website/phone and stick to my guns so to speak.

I'd ring them.

I'm sure they're the same crowd that tried very hard to muscle in on my claim.

I looked up reviews on them, while there some ok there are many, many complaints.

Plenty suggested they try and milk the claim and then write off the bike. Also there were complaints where repairs were done folks weren't happy with the standard.

They also sell off insurance write offs..........

OK, a few points to bear in mind

The third party whilst admitting liability (which is a good start) are also assuming that you will accept the offer they have made hence why they have sent you a cheque.

They will always offer trade value. You need to point out that unless you work in the trade, you do not have access to trade price vehicles so you require a retail valuation, or you need a settlement that allows you to retain the salvage plus a cash lump sum to you.

They do not yet own any salvage until you agree, and they cannot take possession without your consent, and until you cash the cheque they have not paid you anything. If you need to argue the point, hold onto the cheque and hold onto your bike.

You are potentially liable for any loan agreement if they provide you with a bike, and I have seen some people hit with hire bills for several thousands of pounds so just be careful

Repairs arranged by the third party insurers are usually sub standard because they are paying the sub contracted company peanuts and if you are dealing with a claims management company rather than the insurers direct or their solicitors, again be very careful because the claims firms will look at adding on every penny they can get away with to maximise their profit.

The one aspect that they are correct about is that you do have a duty to mitigate your losses, but not to a minimum (as they quote) but on a like for like basis.

So for example, if your kit is damaged, it can be claimed for on an old for new basis simply because it is safety equipment and is designed to be crashed once and then replaced. Some insurers/claims firms will say it is old and therefore a deduction for wear and tear should be made. If its 25 years old, that is a fair point, but if it is only a few years old, then they are talking out of their arse as bike kit is designed to last years, so old for new applies.

Crash helmets MUST be changed on the grounds of safety, but this is where the mitigate your losses comes in, in that you cannot claim for a £500 Arai if you were wearing a £50 polycarb AGV (as an example) You can't claim for a top of the range Dainese leathers if you were wearing a set of cheap Blackbush market off the peg £75 jacket/trouser combination (you get the drift?) it has to be like for like.

What they probably have not told you either is that you are entitled to claim all your out of pocket expenses. That may be public transport to get to work, the additional fuel you are having to use to use the car instead of the bike, any loss of earnings etc. In short any loss you have suffered as a result of the third parties negligence can be claimed for and you are still mitigating your losses.

The bottom lime is that as the claimant, it is the obligation of the third party insurers to return you to the position you were in prior to the crash. It is not for you to suffer any losses because had it not been for the third party you would not have been in that situation in the first place.

Do not let them screw you over, stand your ground.

Which firm are you dealing with?
Bennetts is the broker.
Sabre Insurance for me and the bike.
4th Dimension are the claims handlers. This is where the bike will taken to be assessed, based in Surrey.
Bike assist team are dealing with loss of earnings/injury and all manner of milking the system.
Logistics team are the peeps collecting and delivering the bike.

4th Dimension have grim reviews on Trust pilot.

You have every right to be concerned. I have crossed swords with them on more than one occasion and their reputation is lets say undesirable. Everything is about shoddy quality for maximum profit.

Sabre Insurance are responsible for ensuring you are not led up the garden path and that you are properly compensated, and you always have the option of going to the Insurance Ombudsman through the Financial Conduct Authority.

They must also deal with your claim in a reasonable time as they also have a legal obligation to mitigate their losses.

FFS mate be clear from the start the other person is responsible for their actions and your losses so its up to them to sort it out with no monetary loss to you it really is that simple when you cut through the bullshit

Dont let them take the bike until you are happy with the settlement, they have no right to despite what they may tell you, if you want to keep it and repair yourself tell them that now and stick to it then negotiate the price and remember they will lie at every turn in order to give you the minimum they can and the more companies involved the worse it is for you as they all want a piece of the pie

Again do not let them take your bike for any reason until you are weighed in fully, i worked in the repair industry for a short while and the practices are poor bordering on theft at times I really cant stress this enough ! any repairs they do will be sub standard without a doubt so if you keep it and cant repair yourself then get it done at a shop of your choice at their cost (you will need 3 quotes)

If they do write it off and you let them remove it make sure you are paid first or it will take months (if they are slack recovering what will have become their property then tell them you will be charging them storage)

Lastly never accept the first offer you want the amount it will cost to replace like for like, same condition and very similar mileage even down to if it was a 2 owner bike then that what you want so start looking at adds for similar birds (expensive ones) and save them as proof that it will cost you x amount to replace like for like

Fight fight and fight again until you are happy mate because if you try to be nice and reasonable these bastards will bend you over and go in dry

The ball is rolling, made my mind up and told them, No hire or replacement bike required.
I had similar shit when the car got T-boned a couple of years back.
I got the car repaired at my cost and a few visits to the scrapers for parts total cost about £250.
My then insurance claimed that the repair bill was almost £3000?
When i rang to challenge that dubious amount, the bitch on the phone got a shitty on with me and told me to ring the underwriters and slammed the phone down on me.
We ALL know insurance is LAW, but not for the common man it seems.

Ok, this might sound daft but if you're not claiming from your insurer why are they involved?

You mentioned earlier that your insurer had acknowledged that you were not making a claim on your policy.

4th dimension are not acting for your insurer. Your insurer has simply passed your details on, possibly getting a fee, to what is effectively an "ambulance chasing" company.

You can deal direct with the other driver's insurer yourself, using TC's advice.

I guess you need to decide what you want to, is it repair or write it off?

Once you know you can decide the best approach with the other driver's insurer.

In my case it was cosmetic/bolt off/on damage so I put together the cost of replacement parts and said I wanted to do the work myself.

This saved them a fortune so they agreed and added in a "goodwill" amount on what they paid out.

The other suggestion I'd make is that you can be much tougher than you can with your own insurer usually in terms of write off value.

If it's all possible at this point get 4th dimension canned and not involved.

Ok, the plot thickens.
I contacted the 3rd parties insurance.
Very helpful and when I asked what exactly the cheque off was for?
The reply was 'damage to my vehicle meaning to cover repairs'.
That is not what it states on the letter, it actually states: 'Payment in respect of the estimated value of your vehicle'.
Oh? right, Well the person who wrote the cheque has gone home and she will ring
to clarify what it is exactly for.
What time is best for you?
Excellent I said, now what are you going to do about my crash helmet? It's a one
shot product and needs replacing.
She totally agreed as she used to do motocross and will mention a replacement lid too.
So I await a phone call tomorrow.
