Recall,reading of,someone who found a people,carrier mysteriously parked in their driveway for a few weeks. Turned out they had parked in the wrong drive - a friend said they could use theirs while they went on holiday from the nearby airport.

Civil law is based on precedent where available. Mah I refer my learned friend to the famous ‘Yeovil Glove Company’ and ‘National,Westminster Bank V Morgan‘ for fascinating cases where no precedent had been set.

Criminal Law is based on statute.

At least its outside, did you know that there is nothing to stop people parking on your drive. If it's on your drive the council has no jurisdiction and the police can't help as its a civil matter of trespass.
That's where a punch in the face is called for.

Had that at my last house on Boxing Day, completely blocked them in with the Horsebox, couple of hours later a knock on the door “excuse me can you move your van please, I need to get out” “no” “excuse me” “I said no, I will move it when the five pints of Stella have worn off” “are you refusing to move it?” “No, I’ve told you I’ll move it when I’m below the limit, you wouldn’t want me to drive whilst drunk would you?” He went back to a house in the next street, I moved the box the next morning.

No its not, much is based on Common Law, particularly the most serious offences such as Murder, Manslaughter and the like.

To go back to the original point, the matter is a Police matter and should be dealt with by them.

Simply parking on the road constitutes an offence of obstruction (but reality kicks in and a blind eye is turned), but park across a driveway ort on a footpath the offence is absolute and starts as unnessacary obstruction and then once told to remove it becomes wilful obstruction which is an arrestable offence and can carry up to a maximum of 5 years imprisonment on first conviction.

The offence of Unnecessary Obstruction comes under the Construction and Use regs and states
Regulation 103 of the Road Vehicles (Construction and Use) Regulations 1986 creates the offence of unnecessary obstruction. No person in charge of a motor vehicle or trailer shall cause or permit the vehicle to stand on a road so as to cause any unnecessary obstruction of the road.

There is also a possible section 22 offence which states
Section 22 of the Road Traffic Act 1988 makes it an offence for the person in charge to leave a vehicle or trailer on a road in such a position or condition as to cause a danger to other road users.

That is just for starters, however most Police forces can't be bothered to deal with issues such as this as they think it is below them, but the above offences exist and the Police should deal or arrange to have it removed.

As a by the by, an Audi was dumped about half a mile down the road from me today (it wasn't there when I went to work at 7am)

When I came home at 5 a removal notice was on the windscreen and when I went out to get a takeaway at 6pm the tow truck was in the process of removing it, and it was not stolen apparently, it had simply been parked half on the pavement partially blocking a driveway.

POLICE Matter, it is a matter for them to deal with...
