your fault

Someone i know (he is an advanced bike instructor ex police rider) was riding down the road slowing down for a crossing a woman steps out in front of him looking the wrong way she wasn't on the crossing he had no chance to do a thing and hit her..she is now on life support and not looking good she banged her head on the landing he has been told if you run someone over it is ALLWAYS at least 20% your fault so expect a heavy claim if she lives and one from her family if she doesn't ....how mad is that ? how can they say your always at fault if you knock someone over

You can't say that and anyone who told him that is, IMHO, a buffoon and should familiarise themselves with the law of torts.

Hope he gets over it and obviously best wishes for a speedy recovery to the pedestrian.

He has got legal advise and has talked to old friends in the met thats who told him your always whatever % to blame...also been told not to contact the hospital to enquire to how she is doing as this may be seen as being guilty

My sis was unfortunate enough to be the third car over a 'jumper' on the M5 a number of years ago - sadly it continues to affect her responses, not always in a bad way, but it always brings it back to her.

Didn't make me feel any better when I hit that young girl last April, and the arshole copper who wanted to add to my trouble by wrongly wanting to get my car taken away. Nice police officer who was first on the scene said,"Not your fault, don't feel bad about it," didn't help much. Glad to say that some weeks after the incident her father took the trouble to call me and let me know that she was Ok. How can someone be any% in the wrong if someone puts you in a position that is outside your control? I have heard that if you hit a peddle cyclist you are deemed to be at fault, is this correct Morph?

I have been away for some time, things still look pretty active here :yo:

Unfortunately, when it comes to cyclists, many insurers are taking the view that it is easier to accept liability rather than contest it and fight even though the evidence supports the other road user.

I have been involved in a few cases recently where I have instructed the insurers not to admit liability under any circumstances, but they have then gone and done exactly that and paid out.

In the case of a pedestrian things can get a little more complicated depending on circumstances, but liability has to be determined on the evidence and location not simply on the fact that it involves a pedestrian.

feckin cyclists should ALL be insured, and the fuckers should have to pass a test, have mot's on their bikes INCLUDING lights at ALL times, :mad: had a car and bike written off, because of the behaviour of two fucking cyclists, had untold "near" misses with loads of the myopic pavement riding twats!! :mad:

MPMT, I hope your mate gets off with it, too many pedestrians seem to think all they have to do is step onto the road and the world will move around them, :wank:
Hope the woman comes round too, then she can reflect on the emotional damage SHE has caused to the poor sod unlucky enough to have been in the wrong place at the wrong time!! :dunno:

Your mate is going to be going through it emotionally, even though it wasn't his fault and if, god forbid, the lady doesn't pull through, he'll feel even worse.

Alan was involved in a fatal accident 12 years ago this Friday, not his fault and, like your mate, no way he could have avoided it. He was driving an articulated lorry at the time and for 6 months couldn't go near a wagon without being physically sick so we know what he's going through.

However much anyone tells him it wasn't his fault, he's still going to feel like it was and that he should have done something differently. Lots of friendship and support is the order of the day. Be there for him and give him our good wishes.

That's what a cycling profiency test is, isn't it??? bloody hell we're getting as bad as the sodding germans for not allowing anything unless you've been tested and licenced. As soon as you make a push bike test compulsory it'll give the sodding government another way to restrict our movement/ freedom :rant::mad:

I had years of fun on my bike when I was a kid, used to ride it everywhere, my mother had a fit when she found out how far I used to ride the thing.

Much as I'd be reluctant to let my kids have the same amount of freedom now as the roads are that much busier but to deny them the use of their bikes would be criminal
