Babs is a friend of my daughter Emma & like Emma she is a single parent after her husband abandoned her & their two kids, poppy (12) & Freddie (9), Babs let poppy have a friend sleep over, Babs went to work (radiologist) just before the kids went to school, as the kids were walking to school poppy’s friend said she’d left her phone, poppy didn’t want to be late so she gave her friend her key, when she got home from school the house was trashed, her friend had apparently invited another friend & they’d spent the day watching Netflix, they’d made macaroni cheese & trod it into the carpets, they’d poured a Month’s supply of fish food into the fish tank, it was later discovered that they’d been through the house stealing things & cleared Poppy’s go henry account £160.
Police said they can’t do anything as Poppy had given her the key, Babs went to see the Mother who was in tears as her child is uncontrollable, she returned most of the stolen property,.
Surely the Police can charge the little shit for stealing from the go henry account.

Below the age of criminal responsibility for the boy, 12 year old could be prosecuted but it is most likely that they would say (apart from as you have mentioned the keys were handed over which is bollocks as their is still a moral responsibility on the part of the kid)that it is not in the public interest to prosecute.

However, if memory serves me right, the parents cn be prosecuted for the criminal element on behalf of the kids and it can be done as a private prosecution for theft and criminal damage.

I am out of touch on family and domestic law not my area operation, but it may be an option.
