Legal knowledge needed

Alright, here we go. On London pavements there are glass bricks in some places. Those bring light to basements. Because they are the roof of the property below they are considered private land. Therefore all bikers in London park their bikes on those since London authorities didn't judge necessary to build more bike parking bays despite the massive increase of motorised 2-wheels (loads and loads of scooters) because of this great, fantastic idea which is the congestion charge - yes I am being ironic, sorry to moan again Roxxo - I know I should be happy about getting buggered dry with a fisful of seasalt but I just can't help moaning!
So anyway, here is frenchuk, happy go lucky, off to Soho for a job, parking the bike on said glass bricks on pavement, forgetting for once to cover the licence plate with a plastic bag (the parking boyz can't remove it - it's criminal damage to touch someone else's property - they would have to call the police to remove it).
And sure enough, when I come back I have a FCUKING TICKET. So I grab one of the parking boys walking around, he says he can't do anything, I say call supervisor, supervisor says OK just send it back, I'll right it down no problem sir. I send it back with explanations and of course you know what follows... I receive a letter telling me my appeal is not admissible, it's pay ?100 or we'll send you big burly men and take everything that belongs to you.
They say "pavement lights are also covered by the footway ban, even if they are set in private land. Unless there is an indication that public right of way is not intended, then they are part of the public highway".
Either they are right and I'm buggered, and they are lying scumbags and I sue them for attempt of extortion.

So... does anyone knows the law re. this pavement/private land issue? Please I am not looking for opinions but facts - thanks!

All I can say is:-

Under the Road Traffic Act, a road or highway is hedge row to hedge row, or building line to building line, unless otherwise stated. This includes the foot path or bridleways alongside them.

any help?.

The London Parking and Traffic Appeals Service's Chief Adjudicator, Martin Wood, says: "There seems to be a common misconception that pavement lights are not part of the footway. This misconception seems to be the root of much of the problem. People should not assume that pavement lights are not part of the public footway and that therefore they can park on them.

Where the footway begins and ends is a matter of highway and road law, not parking law. As we have said, each case depends on its own facts. The only safe course is not to park on a given area unless it is quite clear that it is not part of the footway. I would be wary of parking anywhere that the public, using the footway, were not physically prevented from walking over, by a barrier of some kind such as a wall or fence.

intresting point about the bag of the number plate...how does it stand though? surely by covering it you are breaking some other silly law?..or not as the case may be??
orad tax as to be on clear view otherwise you are commiting an offence and get fined accordingly...so what about plates??

Covering the plate won't help much anyway..... the registration number is written on the tax disc and faliure to display it carries a fine....so they've got ya by the danglies whatever you do.

thanks lads! It looks like I'm gonna have to take legal advice, as it looks liek a grey area - it might be, it might not be... as for licence plate covering, EVERY SINGLE BIKER riding his bike everyday in London and parking in the streets does that (except me when I forget :bang:), and NO COP give a ticket for silly law braking as you do whatever you want with a vehicle when it's on PRIVATE LAND provided it does put the general public in danger... And Steve you're right about the tax disc - but they can't read your tax disc if you park your bike with the left side parked against the wall! And then theparking boys can't touch your bike because they're not part of any law enforcement agency so it would be criminal damage if they touch your vehicle... Anyway that's me giving a bell to my sollicitor tomorrow! c7u8
