Seriously (as this is a legal beagle thread), I guess the argument raised by the Plaintiff against the "Act of God" clause was won on the basis that the defendant/s could not produce him/her/it in court to give evidence to counter the claim.

Only just noticed this thread so my reply may be too late.
1993 I came home from work at lunch time, I put my bike in the garage & went into the house, Bev asked me to go pick eldest daughter up from the stables, so I went out to the car, I noticed pieces of glass over my drive & sticking in the paintwork of the bonnet & drivers door.
Next door neighbour's daughter had opened her bedroom window & left it off the snick, the wind caught it & forced it back so hard it smashed.
Neighbour informed his insurance & they paid for a respray without quibbling.

Neighbour refused to pay up, I stopped short of twatting/threatening him, now going down legal route, he refused to disclose the name of his insurance company, he has now let his property out..
