E-Bay problem.

Advertised my sons helmet on E-Bay and it sold. Had no contact with the buyer for about a week despite E-Mails from me. About to re-list when a cheque arrives for the helmet...happy days :-: , from a lady in Malpas, newport, in Wales. Pay cheque into B.S. Few days later check account on line, shows cheque has cleared, send helmet off to purchaser...no probs. Today, letter from B.S. to say the cheque has been stopped :bang: . HMmmmm, search on line the ladies address exists and she is listed as living there, or someone with her name. No telephone number for address given. Phone mobile No given with E-Bay address, lady answers says she is not the person I'm after and she is not speaking from Malpas, though she did have a welsh accent. Checked on E-Bay and the same person has just purchased a childs M/Bike and got good feedback. My question is....am I about to get ripped off and if so do I have any comeback without resorting to Queensbury rules? It may work out but I have a gut feeling that %$fan :xm

If the cheque had cleared then surely the cash is in your account? And is now too late to stop the cheque :dunno:

When you pay a cheque in, the amount shows on your balance at the close of business that day even tho it's not cleared yet. For (another) example, now that LloydsTSB internet banking and cashpoints have gone "live" I can pay in a cheque and it'll show on my balance in the time it takes to walk over to the cashpoint.

If the cheque then bounces or is stopped... they just deduct from your balance. Daft innit?

E-Mails and letter sent, I suppose at the end of the day I have the address. I did wait 7 days after the cheque had been paid in, I think I'll speak to my B.S. to see what they have to say, in my opinion if its not cleared they should'nt show that it has :dunno: .

Building Society cheques

You can not stop a building society cheque ( I am asuming BS means thats what you got) the only way it can be stopped is if the person who issued the cheque ( the buyer) & the person who the cheque is made payable to (you) agrees to do it in writing to the building society.

& if it showed cleared funds,, then thats it,, its cleared,, sounds like a scam to me,,

issue a BS cheque send in letters from buyer & seller to stop said cheque,, easy really ain't it. :dunno:

Of course I could be talking a complete load of bollocks ,, :} but it is early.

Nah, the cheque is from a bank, I paid it into my B.S. account.

Quick Update. In my first post I said they had purchased a childs M/Bike from someone else on E-Bay and got good feedback........well I've just made contact with that person and guess what, yep cheque for over ?400 stopped just after he'd sent the goods by carrier. :mad: :mad: :mad:

I was involved in something similar a while back.. Went for a little ride with a few mates.. knocked on the door and a woman answered it saying she knew nothing and it was bugger all to do with her.
We started removing the wheels from the car in the drive .. she said she would call the police.. we said go on then..
10 minutes later a bloke turned up with the wonga.
Oh just though Jono..
can you post this Ebay users name for us please.. Just in case you understand..

Unfortunately, cleared doesn't always mean that the funds are available in the other person's account. The funds may have been added to your account as cleared, but it can actually take another day or two (sometimes more if there is a weekend or bank holiday) for the cheque to be bounced from the payers account. Then the 'cleared' funds are removed as the amount has not been settled. The same goes for stopping a cheque. As long as the cheque has not been issued with a Guarantee Card then it can be stopped before it it presented to the payers bank.

The cheque doesn't just have to be cleared - make sure that the cheque has been presented and the funds settled from the payers account before parting with any goods.

Report them to ebay and get them removed - probably all you can do without resorting to a personal visit.

Certainly, goes by the E-Bay name of RINGROSE1971. Do not touch with a barge pole. A baseball bat :eek: maybe but not a barge pole!

Good news, following, ahem,erm, a "visit" :eek: the person in question has promised a new cheque in the post tomorrow and the guy who sold the M/bike has been paid by visa. It has all been a misunderstanding apparently. :rolleyes: I'm sure it will all end well 'cause he doesn't want another visit. Thanks to all for offers of support etc, you know who you are. :bow:

Well i can tell you that the law says that is fraud, i recently had a customer do a stop on his cheque, i went to a solicitor and apparently there is NO DEFENSE if you stop a cheque so go see a solicitor or citizens advice centre,
if you explain that you will take them to court mabe they will coff up. thats if they dont do a runner before you get there, dont letem get away with it whatever.
