A bit of legal advice

:mad: On the easter bank holiday Friday I had to work and my wife Ros gave me a lift into work, now bearing in mind that it is the easter bank holiday there is not a sole on the road (except us)8.15am in the morning and there is a white UNMARKED Escort van parked in a layby which just so happens to be a SAFTY CAMERA van (like feck :mad: ).

So what do we get this morning a nice summons to say that the b....ds are going to prosecute my wife for speeding 40 in a 30 zone.

Now what realy winds me up about TWATS like this is if they are so called safty camera vans then WHY are they not marked as such and why are they parked up in a layby just off a bend so you don't see them untill it is to late.

So as you can tell I am not to pleased with the way we were caught so called speeding, so my question is how do we stand.

Any serious advice greatfilly received,

Check their web site to make sure they announced their route for that day. I know nothing else. I never speed*

How did you know it was a "Safety Van"?

If it was marked on the side of the van then, sorry mate there aint a lot you can do

I got caught front on camera - bastids moved to the front of the van and WROTE DOWN my number

They don't have photo evidence of the number plate

Yet I've been advised - don't fight it - you won't win and could end up with more than ?60 and the 3 points

Bastids aint they?

Read the summons

It basically tells you to pay up or else,, phookin bastids did me for 36 in a 30,,,,, not much you can do apart from pay up,,,,,,,,, :bang: What you should have done was stop along side the van & twated the bastards,,,,only a question of time B4 some one does.

have they asked you to declare who the driver of the vehicle was and do they have a photo of the driver and passenger?
If so, ya probably in the pooh, if not, d'ya know anyone who lives abroad who'd be prepared to admit they were driving the vehicle?
If so, ya simply complete the NIP, advising them that the driver was said person and let the authorities take it from there.
Only realy works if the person abroad has a non-UK license though.

Tell them OSAMA BIN LADEN was driving it (unless the photo shows that your wife clearly does'nt have a beard) and let them find him!

Seriously though, just take it on the chin and put it down to experience.
They do not have to advise you of their presence, they sometimes do if its a pro-active setup but if they want to make an example of a few to get word about then they'll just do it!! They can't stop you unless either the vehicle is marked or the operators are uniformed cops hence the summons through the door as opposed to you being advised roadside...
What we need is more traffic cops doing it the old fashioned way.

If these circumstances are exactly as described, there is next to no way that they can get a conviction to stick (continuity of evidence (I think !). Fight the w4nk3rs all the way. man8um man8um man8um

I WOULDN'T BE BULLIED INTO SUBMISSION. c7u8

Any half decent solicitor will get you off, It'll probably save you a load of money in the long run.
