Well, things are looking up.
Received an email from my insurance stating that the 3rd party are willing to settle my helmet claim, but dispute the Iridium visor and pin lock, OK I tried that one on for effect & I can still use the visor and pin lock. No biggie.
However, they have queried the phone damage & wanted to know where it was stored at time of the RTA?
Rather a bizarre request I thought.
Anyhow my insurance have stated that my previous repair/replacement quote from an independent dealer should suffice.
Nice fat cheque for Crimbo hopefully.

I'm guessing that you are referring to our hard working posties?

1 they want them to work more overtime but aren't going to pay them for overtime anymore, they are going to "bank" the extra hours.
2. they will no longer pay sick pay

3. they want to change the hours they work
Also at the moment around here if you are out when they try to deliver a parcel they will return it to the sorting office where you can go and collect it, that's going to stop.
No letter deliveries on the weekend, but the posties will be expected to work them delivering parcels but as unpaid overtime

Sadly the post office is another industry that has been clobbered by advances in technology and beaten up by the newcomers that haven’t got the millstone of old infrastructure hanging round their necks.

Woukd be interesting to know how many letters get sent now compared to say forty years ago.

Today I received a letter from the NHS delivered by the postie. So this way the postie gets work to do, however the letter was nonsense letting me know they’re sending me a bowel cancer check package - why not just send it? It is coming regardless of if I want it or not - yes I will use it

That way the NHS would save on paper, envelopes, postage and the time taken to generate all of it - releasing money back to the system.

It is really taking the piss wasting money like this to how many thousands of people each year.

I'm getting sick to the back teeth of people going on strike and whinging that they want more money, with the NHS being the biggest culprits. Don't we all want more money! It seems to have escaped their collective attention that we had a pandemic last year and the year before. Hundreds of businesses were saved and, in turn, so were the jobs of millions of employees by the furlough scheme. Where did the money for furlough come from? The Treasury. Where did the Treasury get the money from? Oh yes, that'll be the tax payer. There's no magic money tree. Public service employee pay rises will have to be funded by the tax payer and if their demands are met, then we pay even more tax. I pay enough as it is and don't want to pay any more.

As for the change in conditions that the Royal Mail are trying to impose on the posties, I didn't know the extent of them and I agree that they're not acceptable. I take back and apologise for my comment about the posties being twats*.



*with the exception of one, that being a post girl around here. Our regular postie is a great guy who goes out of his way to help. This particular lazy bitch I refer to deliberately fails to complete her rounds on Fridays and/or Saturdays if she happens to be going out that night. She has a reputation for it; a couple of posties around here have told me that.

Another feckin request from the 3rd party. Now they want photos of the damaged phone even though I have sent a repair/cost quote already.
My claims handler reckons they're
just dragging their feet and I have provide enough evidence already.
There is no external damage as I've already stated... Told my claims handler
that I'm not sending anymore pics of anything related to the RTA anymore.

Third party adamant that they are not paying for a new phone replacement as not enough evidence.
So... I replied that, why would I go on any journey with a non working phone?
Ombudsmen to the rescue me thinks.

Good luck, in my experience the Ombudsman usually sides with the insurer

In my 40+ years of dealing with the Ombudsman, my experience has been the opposite as they usually recognise that the insured are not experts and are often taken for a ride by the insurance companies.

Insurers do not usually want complaints made as it is a statutory £400 fine just for having te complaint made.

The insurers are obliged to work on the balance of probability and they know that in this day and age most riders will have a phone with them for all sorts of reasons. (tracking, emergencies etc), and so they (Insurance company) are being very unreasonable and not playing by their own rules as they are clearly wanting to try and get away with some penny pinching

I used to own a Mazda 323, I was driving to work & stopped at a red light, just ahead was a bus stopped at a bus stop with a lady on a moped parked behind, as I set off the moped pulled out in front of me, I swerved to avoid her & demolished a plastic bollard, the lady rode off then turned round & apologised to me, she gave me her phone number so I could ring for her insurance details, when I rang, she or her husband had decided she wasn’t to blame, I was insured through Chestnut insurance who advertised in the poa magazine, they were based in Cheshire, my next door neighbour was good enough to loan me his Granada when available but generally I had to walk the six miles to work & get a bus home,
After a few weeks of hearing nothing I started pestering Chestnut & eventually got the go ahead for repairs, I asked “does this mean she has accepted liability?” “Yes”
A couple of Months later the repair garage contacted me & they had not been paid so I contacted Chestnut who said no authorisation had been given for repairs, I reminded them of the phone call & asked why they gave me the go ahead, the answer knocked me for six “well you sounded fed up so I thought I'd cheer you up” I contacted the Ombudsman who sided with Chestnut.
Not letting it rest there I contacted Bury & Walker Solicitors who fought my case, & just before going to Court the other insurance agreed to pay half of everything.
The initial repair bill for car & bollard was £800 total, as the case had gone on for over two years my Solicitor got the total to over £2,500 so I received a pay out of £1,250.

This is probably the end of ALL correspondence with the 3rd party.
Makes you wonder WHY full comprehensive is an option.
I cannot give any more evidence.

In cases where there are losses that are not agreed, we would consider litigation against the third party insurer. However, in this instance, the prospect of us being successful is very unlikely as the evidence provided does not definitively prove the accident caused the phone to become damaged, and the comments provided by the third party are fair as they can only go by the evidence and information provided to them.

As there is no visible damage to the mobile phone, and the quote for repair doesn’t have any details about the damage or how it was/could have been caused, it is very difficult for us to prove it was damaged because of the accident.

It could have all blown up in my face & my morals & sense of justice could have cost me thousands of pounds, I got lucky but I know if I had just accepted the ombudsman’s decision it would have eaten away at me.
Ask yourself “is it worth pursuing the claim for the phone or do I put it down to one of life’s injustices?”

If it the RTA was in the car, all contents would have been covered.
Most new bikes now have usb for phones, heated gloves and the like.
I wonder if they are covered as with a car. I will probably cut my loses and move on.
