Just realised that my last round of speeding points have been wiped from my licence.

Yippee....!

Think I'll go for a blat to celebrate. :D

Read an article yesterday that suggests an acceptable excuse for exceeding the speed limit is someone tailgating you, so speeding up to take yourself out of the danger zone.

Not sure it's that simple though, I'll let you know if it works when my 122 in a 60 zone comes up :D

Don't bet on it. One of the nickings happened when I was on the M27 and in the RX8. I was sat in the outside line doing 80 and only just faster than middle lane traffic. A large grey Beemer saloon came up behind and sat on my tail. I was less than happy about the distance but there was nowhere to go.

Eventually a gap opened up in front so I booted it and found a slot in the middle lane.
Then I noticed the flashing blue lights in his grill....

In 30+ years enforcing traffic law plus another 10 investing the aftermath, that is a new one on me as the rules state quite clearly that if you feel threatened by the presence of another only vehicle, then pull over and let it go past.

Speeding up to get out of a "danger zone" might be deemed a good due care or even dangerous case on top of the excess speed. It is not a valid defence I am afraid.

The only time it is deemed a legal defence to excess speed is if you were acting as an Ambulance in an emergency, and then you still have to justify it and onus of proof will be on you.

Can't see any defence whatsoever if you were doing 80 to start with!!

Plod may well have been trying to get on and do their job (blues and twos not always appropriate) when someone wouldn't move out off the way in lane 3 while exceeding the speed limit.

Lock and throw the key away as far as I'm concerned.

What if yer paranoid and everyone is tailgaiting you?..Yer honor..:D

No defence.

But once convicted you will be advised to seek medical help as a matter of urgency (y)

I had traffic in front of me... Hence I had to wait until it cleared to proceed. You might even be able to put 2 and 2 together and work out that I was keeping up with the traffic in the outside lane.

I had traffic to my left... Hence I had to wait for a gap.

Slowing down was not an option.

If he wanted to get by then he was still going to have to wait, for the same reasons I had to wait. Putting the blues abd twos on would have made little difference due to the amount of traffic to the front and side. :facepalm:

If you hadn't been doing 80 you wouldn't have needed to be in the 'outside lane'.

Sounds like you hadn't left appropriate gaps around you or anticipated traffic flow effectively either.

I have proof of getting away with speeding - you just need a vehicle faster than theirs and false plates*

* Do not try this when the helicopter is up!


** I might have made this up if anyone gets seriously upset.
