Return of bail money

I can find an answer on google about bail money being returned. It only goes on about what happens if you break the rules!

A friend of mine has been on bail while we fought her extradition case! We lost and she has now been extradited. She paid £5000 bail and has kept to all of the rules.

Does the money just get returned to her or is there some process that we have to go through to get it back?

Like I said, I can't find anything other than you lose it if you break the bail conditions.

I appreciate you have added the £ sign. Bail in the U.K. is normally done with / without conditions. Has money been used as a surety in the U.K.?

Yes. She has been a resident, up until extradition last week, for 7 years.

The court and/or the police can require a person to act as surety for the defendant before granting bail. A surety is where another person who is prepared to promise to pay the court a certain sum of money should the defendant breach any of his bail conditions, such as failing to attend court. No money has to be paid unless the defendant breaches bail.


in essence the money is only normally paid if they don’t comply. It doesn’t change hands beforehand. If that makes sense.

Yes, that makes sense but my friend paid £5k. When she was picked up, to not be held in remand, she paid the money and had to surrender her passport and sign at a police station 3 times a week. All of which she did.
