Refund P&P or not?

Refund P&P or not? And possible E-Bay warning.

Mate of mine bought an Airblade D/Bubble screen from a firm called Apex leisure in Preston I think. Anyway the screen had an imperfection and he sent it back to them to check. They decided to refund him the money but said it was only a tiny imperfection and he could'nt expect a perfect after market screen to be made to O.E. standards. He paid ?45 for the screen plus ?5 or so P&P. They have only refunded the ?45 and are refusing to refund the P&P as they say they are having to pay for it to be sent back to the manufacturer? They also have to cover the re-stocking charge? So he is out of pocket for the initial P&P, and also the P&P for returning the screen to them. That can't be right can it.....any thoughts? :bang:

I've had similar experiences and had to pay for extra postage.
Also a good few years ago we had a new carpet fitted in the dining room and a day later we noticed a flaw in the weave. On contacting the shop they were very helpful, full of apologies and said there was no problem the carpet would be replaced. Great a fortnight later a new carpet was laid but I had to pay for the refitting! The orignal price per square metre included fitting and the fitting was contracted out. I didn't argue and just paid up.
If the same happened again I would argue the case but legally where do I stand. (over the flaw in the carpet) Not very funny I know :dunno:

Always a dodgy one here mate

I suspect that the contract of sale is for the screen only [it's faulty therefore replacement or refund - no question]

However he has paid for a delivery service which has been completed satisfactory - he got his screen so that part of the contract has been satisfied

He can try it on but I guess he'll get nowhere and for a fiver it's not worth the small claims court

Sad but true!

Thanks for the replies, call me an old cynic....but.....an Airblade screen has appeared on E-Bay item 7916764341 being offered by Apexperformance from Preston? on a 7 day listing starting on 16th August, thats a few days after the faulty screen was returned and some of the money refunded! Its advertised as brand new, never been fitted? Now I may be wrong, but I have a sneaky suspicion that if you were to bid and win you would find a small chip out of the plastic on the left side as you look at it, just where the bubble begins to rise. But all aftermarket screens are like that.....are'nt they? Well my MRA isn't! :lick: Now that CAN'T be right if it is the screen that was sent back? :eek:

Just a thought Jono, but did your mate buy it with a credit card? If he did it might be worth contacting the card people, he might get a result.
