What was the date of the incident? Add six months to it and if you have not been served a summons before that date no action can be taken and that date, by reckoning is getting closer by the day! Should one arrive, it would probably be arguable that late service was an abuse of process, especially as this was a very simple RTC with no complications. Interesting!

Have the rules changed then? It always used to be a requirement that information had to be laid before magistrates within 6 months of the date of the alleged offence unless there were specific mitigating circumstances, but the summons could be served some time later once the information had been laid.

I know there have been a few cases where the summons were issued several months later but information had been laid and the argument was made that for the summons to be served so long after the incident was unreasonable.

The court threw it out.

But if the rules have changed, (which is possible) then I have learnt something.........

It is my experience that the laying of the information runs hand in hand with the issue of the summons, mainly because the case building team within my force look after both aspects of the process. I would suggest that with the cut off time looming any process will be rushed, and it is likely that the OIC is going to have a lot of questions to answer as to why it has taken so long. Under the circumstances I reckon that this will not be a runner. My thoughts are that the OIC is a Pro-B or very young in service with a huge case load they are struggling to manage and has fu@*ed up, hence the email sent apologising. It would not surprise me that within the next three weeks this will all be over and forgotten about.

its not been dealt with right from the start so any thing they do now will be much the same as the start of the job a waste of time.
I dont envy any long standing officer that join to make a difference and protect this land as there now just having to tick more and more boxs to please the stats.

And the most funny thing about this is that it is one of them GOOD officers that told me to stand up to them for that very reason it has been dealt with all wrong from the start

Personally based certainly on the last year, we don't need speed cameras but we certainly need an increase in cameras at red lights.

I'm with you on that, Noob. @tu*

If they were genuinely out to make the roads safer then putting cameras at a lot of traffic lights would get my vote. They'd probably make more money too....:eek:

The lights at the bottom of the hill by QA Hospital (Portsmouth) would be where I'd put the first one. It's unbelievable how many vehicles AND the odd cyclist run the red lights..even when there's an ambulance with blues and twos coming through.

Feckin' eejits. :bang:

I dont run from any thing, I just stand up to what i think is right, just like the Ex wife she got paid what she needed not what she wanted, thats a point iv now stopped paying her
and life is so much better.

Mate i feel you pain, mine was still no cheap but it at the end now the kids are grown up and i have moved on her on the other hand has not
and as much as she would like me to still be paying im not.
