Bank Holiday entitlement.

Does anyone know if there are any rules/laws relating to bank holiday entitlement?

My reason for asking is this: I work part time, this being a week on week off rota, 39 hour week Monday to Friday. In these circumstances I am wondering how BH entitlement is calculated or is it just pot-luck which ones fall on my week on.

Another example I knew of a few years back was of a lady at my wife's place of work who worked part time, but it was all day Monday and Tuesday and Wednesday morning. Her oppo worked Wednesday afternoon and all day Thursday and Friday. The lady who worked the second half of the week missed out on the Monday BHs and this always seemed unfair IMHO.

Any opinions or facts would be gratefully received. Thank you.

I always thought it was pretty much down to each employer to decide their own way of doing things but if you signed a contract to begin with then it should be explained. If you haven't got/can't find your contract then you can ask hr for a copy.

I seem to feel that with the exception of a few tax payer funded jobs then for most companies, the old ways of bh extra payments, unsociable hours payments and the like, are largely things of the past

I'm sure someone with more knowledge will chime in.

BTW using the irregular hours scenario and entering your hours worked per year as 39 * 26 (ie to allow for your week on/week off scenario)


The statutory holiday entitlement is 122 hours and 22 minutes for the time that’s been worked.

The employer:

can include bank and public holidays as part of the statutory entitlement

must not round down the holiday entitlement, but may round it up

must provide holiday pay during the statutory leave

can provide more paid holiday - this will be in the employment contract and is called ‘contractual leave entitlement’

Also not sure if helpful but the contract I was on previously gave me a total of 36 days annual leave (28 statutory + 8 BH) to take whenever I chose as working Bank Holidays was considered part of the normal shift rota (for which we did get a shift allowance)

In reality it wasn't 36 days but something like 19.5 shifts as we worked 12 hour shifts 4 on/4 off ( 2 lots of days/2 lots of nights)

Oh how I miss taking 20 days off at a time twice a year (plus another 12 day break) ;)


20 days off:
4 days rotad off
4 days AL
4 days rotad off
4 days AL
4 days rotad off


12 days off:
4 days rotad off
4 days AL
4 days rotad off

Outrageous!! A lady that doesn't work on Monday's doesn't get the day off as she's already off.

My wife doesn't work. She misses out on all of them. No idea how she copes!

conversely, the woman who works on Thursday and Friday has to take every Good Friday as annual leave, whether she likes it or not!!

I work within an organisation where bank holidays are given pro rata for the working hours, for example somebody who works on a 0.8 (4/5ths of the wte) gets allocated only 4/5ths of the bank holiday entitlement.
As it is all rolled in to annual leave, which for some weird and wonderful reason they calculate in hours rather than days, one just has to be careful in spending the hours (particularly when Christmas and New Year leave can eat such a sizeable chunk of the time (which I resent as I am the original Scrooge about this time of year))

So if (to keep it simple) a full week was forty hours someone working forty hours got all seven Bank Holidays off. If someone was working twenty hours they were entitled to 3.5 Bank Holidays off, the 'other' 3.5 had to be taken as leave.


Always a bit of a thorny subject though.

Mind you, I have never understood why anyone other than bank staff should be entitled to Bank Holidays in any event.

Still marginally better than having to take all the school holidays and pay premium prices for travel though :-0)
