Last Thursday I got back from taking Joe to Rugby practice at 7.45pm to find a Nissan Qashquai parked mainly on the pavement & partially blocking my double gates, next door neighbour says he saw someone trying to start it, Saturday evening I rang 101 as it was still there, “we can’t do anything as it’s not causing an obstruction” “er yes it is, anybody on a mobility scooter or pushing a pram can not get past” they gave me an incident number & said they’d contact the owners, it is still there & whenever I ring 101 I get the message “we are experiencing a high volume of calls your call will take an hour” I’m thinking of contacting Bev’s Cousin to come with his breakdown truck to move it.

Where I used to live we had designated, numbered parking bays which we paid for, johnny foreigner decided our bay belonged to him as his was already filled with his wife's car and we only got 1 space each, I asked politely for him not to park his uninsured unroadworthy, untaxed heap of shit there more than once and he wouldn't for a few days then the whole process would start again :mad:

Funnily enough I have a mate with a beavertail truck and few qualms about using it and the problem was solved ;)

I’m thinking of contacting Bev’s Cousin to come with his breakdown truck to move it.
It’s been there a week, they’ve had more than ample time to get it removed. If I were you, I wouldn’t hesitate.

Have you a drop kerb in front of your gates ?
No but even if I did there’s nothing I can do as it’s not blocking me in, I can get one gate fully open & one partially, but if the ind caught it it could blow into the car as I cannot fasten the gate open, I could always secure it to the Qashquai.

I take you've checked tax/mot status on line?
Although I don't think the council would fall over themselves to remove it.

I suspect its one of those situations where legally there's not much you can do.....

As far as I’m aware, it’s illegal to park across a drive if there’s a dropped kerb (it’s illegal to park across any dropped kerb, driveway or not). However, there’s two potential sticking points; if the homeowner fitted the dropped kerb without the planning permission and subsequent knowledge of the local council, then you’re buggered. If there’s no dropped kerb to begin with, you’re buggered.

Also, Dibble are not interested because blocking drives is a civil offence and not criminal but that works both ways………

It’s a five second check on the DVLA website if the car is taxed and/or MOT’d. If it’s not road legal, report it and it’ll be clamped pretty quickly. The DVLA will not pass up an opportunity to make a few quid!

I have done research, it is not a dropped kerb (yet) it is not illegal to park blocking someone’s drive unless it is preventing a car from leaving, I have checked & the car is taxed & tested till April next year, the only laws it is breaking are obstructing pedestrians & it is facing the wrong way.

Could it be it's genuinely broken down and the owner is trying to move it?
Must say though if it was me I'd have knocked on your door/left a note/contact and apologised.

These days lots of folks park partially on the footpath, while they shouldn't there's a generation (or more) of drivers who apparently don't even realise they perhaps shouldn't (probably the same twats chucking rubbish out the windows happily).

Sadly you've confirmed you don't actually have a legal right to use your driveway, the car is road legal so there is no legal remedy available to you.

I've known people to make sure anyone doing that is blocked in so can't leave without knocking on doors and persuading the car owners to move - which they may do eventually.

Of course there can also be a risk to that :)

I could block them in but as they are parked on a bend it would be awkward & hazardous

I had this years ago and by chance it was the day before builders were due in and access was needed. I dropped a note through about twenty local,doors and the car was moved straight away, belonged to someone visiting. They ‘just didn’t think’ when they parked it.
Either way, four builders can move a car very easily, one on each corner bouncing it…..

Not quite.

Legal drive with dropped kerb.

Nothing you can if the drive is empty and someone parks across it.

You call plod if your car is on the drive and blocked in as that is "obstruction".
