thats as I understand the legal position.
I have known the DVLA records to be 3 months behind times, so if samster was the Registered Keeper (to be safe) for 3 months before the alleged offence and still was on the day of the alleged offence and there had been no change of details on the V5, then as you say he has to be in the clear.
A summons bundle will also contain a DLVA search form which should confirm the RK and some dates.
Without knowing exactly what is in the paperwork I can't say if there is anything 'nasty' lurking. But if there is not, in samsters position I would go to Court, demand attendance by all people concerned, 'take the p155' ..........and then hand in my costs application.
But then I 'enjoy' this type of thing (sad I know) so much so that I have recently taken proceedings at the High Court against a Crown Court and a Camera Partnership / CPS %$fan
