How come a bloke nicking a teddy from a little girls memorial gets five months more in jail than the guy that killed the little girl whilst speeding in an uninsured car?????

Did you know 'Stan' that us nice ENGLISH men can legally shoot a WELSHMAN with a bow and arrow BUT only on a Sunday.. :bow:

Yes Rhino, but apparently only from Hereford castle, and with a bow and arrow.

But to get back to the point of Smixs thread, just WTF is going on in this country?

Perhaps uninsured drivers should be treated like those with guns and knives, a guaranteed jail sentence.

'fraid it's to do with what the CPS actually decide to charge with.......

if the driver is only charged with driving without due care etc then sentencing is limited to that.

Given the recent conviction by jury, of someone with hooks, using existing laws after the cps failed to prosecute earlier 'cause "not confident of getting a conviction" I'd suggest it may be the CPS's "confidence" that's the problem.

maybe they should trust juries more often. I suppose it's about getting a balance between taking cases to court when the evidence is sketcy and maybe putting folks through the process when there's no chance of convicting??

It does strike me that't there is a subtle worrying side to this CPS business - in essence the CPS actually decides guilt before a case goes to court in that the court don't even get to hear the case if the CPS decide they don't. The recent hookey case shows that they can get that wrong as it would seem the reason for not going to court earlier was proly flawed 'case a jury would convict??
