Driving at 150mph not dangerous says Judge

Driving a high-performance car at 150 mph on a country road does not constitute dangerous driving, a judge ruled yesterday.

Nicholas Whittle, 21, was behind the wheel of his father's Porsche Boxster, and travelling at more than twice the legal maximum speed limit on the only long stretch of straight road on the Isle of Wight.

But because he braked when necessary, the road had no significant hazards, was clear of traffic and away from houses, his driving was not a danger, said Recorder Caroline Lister. She directed a jury at Winchester Crown Court to return a not guilty verdict to a charge of dangerous driving.

The court was told that a traffic officer calculated that the Porsche was travelling at up to 149.9 mph on a road with a 60 mph limit.

Whittle, a carpenter from Totland, denied the charge.

A motorcyclist caught riding his bike along the M5 at 145.9mph has been banned from driving for six months.
Tim Butler, of Almeda Road, St George, Bristol, was stopped by police after officers spotted him pulling out from a slip road straight into the third lane.

Butler, who admitted speeding, was fined ?270 and ordered to pay costs.

An Avon and Somerset Police spokesman said: "It was one of the highest speeds ever recorded by officers and he posed a real danger to other road users."

"There were 16 fatalities involving motorcyclists within the force area last year," he added. "Fortunately Mr Butler has not added to the casualties."

Ah, that will be the total enigma known as the british justice system then!

Can't go having consistency now can we - that might display common semse and intelligence!

standardising punishments can also be a two edged sword!! :dunno: look at the death sentance for instance!!

If a person is a professional driver who has been trained in high speed driving and obstacle awareness etc, and he has been caught exceeding the speed limit a judge may take into consideration the relevant skills of the driver and the possiblility of the risk being lower due to the drivers skills this could result in the driver receiving a lesser punishment than someone without the skills being found guilty of the same offence. I am not saying that I agree with this outlook but judges have guidelines & sometimes by taking each case as a seperate incidence they allow themselves to step outside these guidelines depending on the circumstances.

I don't know Stan, I was just trying to be Devil's advocate [not the sickly eggy drink that grannies have at Christmas] & point out that judges sit through days of Boring Barristers droning on about points of law, and asking stupid people stupid questions, and then they take into consideration all points raised then make their totally unbiased decision.

seeing as i know feck all about the justice system..i'll take your word for it LOL

I have sat through many court cases & I still can't for the life of me understand how some conclusions are arrived at, mind you it may help if I could stay awake during the trials.

I can tell you what skills he had..
He had the skill to be born to someone who is either old money or new.. and therefore be the son of someone who can pull the right strings..

God forbid I should suggest uor legal system is not completely fair and uncorruptable ! LOL ( And my god I should know.. I have been the beneficiary ( sp ? ) of knowing the right people )

The mantra used to be innapropriate speed is dangerous. That seems to have changed to speed per se is dangerous. :tosser:

The magistrate has quite rightly (in my opinion) ruled that speed alone does not constitute dangerous driving. :bow:

Whether his speed was appropriate for the public highway......that`s a different debate. g0551p

I used to do the Court of Appeal a few years ago and for the life of me, the majority of the time I couldnt even understand what the judges were saying, I used to get more sense out of my old granny and she was 102 and in an old folks home :eek:
