Dartford tunnel Changes

I recieved a notice today saying I did not pay for the tunnel quoting the 5th July 2015

Personally I do not remember ever going south of the river in this car that I only had for 8 weeks but lets assume I had a memory brain fart

When I have used the tunnel I have always paid in advance or the same morning by paying online

I check my bank account and it shows a payment to dart on the 2nd of July

so I try to go into my account to see if that payment related to that car, I only have 4 emails address's, not one of the email address's registering with dart so I phone them up.

They give me not much help other than send a copy of my bank statement showing the date and amount and they should be able to see that the payment was related to that car and everything should be ok.

I really need to see my account to see what the sneaky buggers are upto. The only think I can think of is, is there a time period between making the payment as a one of and actually using it?

There was something on watchdog about people having paid on line and still getting a fine

How long before you have to pay for every road:dunno:

am I reading this right? its taken them over 3 months to let you know they are going to fine you?

I was under the impression they had to tell you within 14 days !

I knew about the speeding ticket within 14 days but wasn't sure on dartford tunnel?

If it is an offence there are 14 days to present you with a NIP providing the vehicle is registered in your name ( this is fairly specific as a hire car driver or other than the vehicle owner is somewhat different )

If the failure to pay is an offence then 14 days .. If it is a civil matter then up to about 7 bloody years as far as I can work out :bang:

I'll ask them tomorrow because in my anger after receiving it I didn't read all of it.

They say I owe them money and list me travelling northbound on the A282 trunk road dartford crossing on the 05-07-2013.

So I now owe them ?70 to be paid within 28 days of the date of the letter (the letter was dated the 23-10th and I received it today on the 28th) However if I pay within 14 days of the 23rd then I only have to pay ?35 but on all counts I still also owe them the ?2.50 on top

So I need to ask them about is their a time limit to issue these notices

Why my bank shows 2 days before the 05-07 that I had paid for two trips (?5)

And finally why they list me as travelling Northbound only despite me living in Essex so I would have had to travelled southbound through the tunnel first ( and no I've never used Blackwall) All very peculiar.

My other concern is they want to see a bank statement showing my payment to them however I am worried about doing so given recent failures to uphold private information so I need to clarify if I can block/hide my account numbers and non relevant payments to other companies/transactions

Firstly, it is not an offence and so NIPs have absolutely no relevance in this matter.
Secondly, any claim for money is a civil Penalty Charge and NOT a fine - only a court can issue a fine!

The notice the OP has received is a claim that there has been a contravention of the order that covers the use of the DRC. They are claiming that on the day in question, someone has used the crossing and that the fee (the toll) has not been paid. As they do not know who the driver was, they have sent the notice to the Registered Keeper, who in law is now liable to pay the outstanding charge. The RK now has a legal obligation to either pay up or, by following a particular process, exercise their right to appeal against the charge.

THIS A SERIOUS MATTER AND ONE THAT THE OP MUST NOT IGNORE. THERE ARE TIME LIMITS THAT NEED TO BE OBSERVED BUT HELP CAN BE PROVIDED IF THE OP WISHES TO CHALLENGE THE PENALTY CHARGE.

FAILURE TO TAKE APPROPRIATE ACTION COULD RESULT IN COURT ACTION AT SOME POINT IN THE FUTURE.

It is my view that all civil penalty charge notices and private parking charge notices should be challenged as there are often numerous legal errors made by those issuing the notices. Unfortunately too many people fail to understand the legalities and are effectively bullied into coughing up because of the intimidating and threatening nature of the correspondence received from outfits such as the DRC.

OP - AT THIS TIME DO NOT PAY ANYTHING AND DO NOT MAKE CONTACT WITH THE DRC ABOUT THIS NOTICE. I am more than happy to help you out. Send me an email and I will take you through the options.

Thanks everyone really, paying the fine is not hard but given it's showing on my bank statement as already being paid I do object to double dipping, normally only ex partners try that :-0)

I've got your email and replied.

As I have now entered into private correspondence with Noobie about a legally sensitive subject it is my suggestion that we do not discuss this specific individual matter any further on this thread.

John, can this perhaps be moved to the legal section and perhaps even be locked? I'll let you decide. @tu*
